Jammu and Kashmir after revoking Article 370

On August 5, 2019 Article 370 of Indian Constitution was revoked which was adopted by Indian constitution before 72 years. Article 370 was most controversial article of Indian constitution, which gives Jammu and Kashmir state special status. Dr. Syama Prasad Mukerjee, the founder President of Bharatiya Jansangh (Bharatiya Janta Party) was the first person who opposed it strongly. After his death his legacy was carried out by Deen Dayal Upadhyay, Atal Bihari Vajpayee, Lal Krishna Advani and now finally Narendra Modi government revoked it. Article 370 was adopted by Indian constitution in 1949 for temporary basis. But because of lack of political will it takes 72 years to revoke it. Lets discuss the 10 major changes going to take place after revoking article 370.

1. Dual Citizenship-

With Article 370- Jammu and Kashmir people were having dual citizenship India and Jammu & Kashmir.

Without Article 370- Now Jammu & Kashmir people are having a single citizenship.

2. Citizenship-

With Article 370- No person outside the Jammu and Kashmir can take the citizenship of Jammu & Kashmir.

Without Article 370- Now Every Indian is a the citizen of Jammu & Kashmir.

3. Land Acquiring rights-

With Article 370- No person outside the Jammu and Kashmir can acquire the land in the state.

Without Article 370- Every Indian can acquire land in Jammu & Kashmir.

4. Girls rights after marriage-

With Article 370- Girls from Jammu & Kashmir who married in any other state lose all the rights as a citizen of Jammu & Kashmir.

Without Article 370- Girls from Jammu & Kashmir enjoy the citizenship rights even after marrying in other states.

5. Reservation-

With Article 370 - No reservation was there for minorities, Schedule tribes, schedule caste, Other backward classes.

Without Article 370- Jammu & Kashmir people will now enjoy the benefit of reservation in admission to colleges and government jobs.

6. Constitution-

With Article 370- There was a separate constitution for Jammu & Kashmir.

Without Article 370- Indian constitution will be applicable in Jammu & Kashmir.

7. Article 356 and 360- 

With Article 370- Article 356 and Article 360 which is related to impose emergency was not applicable in Jammu and Kashmir.

Without Article 370- Article 356 and Article 360 of Indian constitution is applicable in Jammu & Kashmir.

8. Flag- 

With Article 370-Jammu & Kashmir had their own flag.

Without Aritcle 370- Jammu & Kashmir now has came under Indian flag.

9. Challenge of Bill-

With Article 370- No bill passed by Jammu & Kashmir assembly can be challenged in any court of India.

Without Article 370- Bill passed by Jammu & Kashmir Assembly can be challenged in court.

10. Assembly tenure-

With Article 370- Tenure for Jammu and Kashmir state assembly was fixed for 6 Years.

Without Article 370- Tenure for Jammu & Kashmir state assembly now will be for 5 years.
